Test Case

Theo: “I’ve never really thought about this before. I mean, I guess I have a healthy enough sex drive…”
Theo: “…but it’s always happened at someone else’s house, someone else’s room. I thought that I couldn’t bring someone here because of the others…”
Theo: “I never thought about the idea of my being…”
Cora: “…a Supreme Court test case?” Theo: “Even the Warren court would have had trouble with this one.”

Loving v Virginia (388 U.S. 1) was the 1967 case that ruled in favor of interracial marriage, based upon the Equal Protection and Due Process clauses of the Fourteenth Amendment of the U.S. Constitution. Chief Justice Earl Warren presided over a unanimous court in this case. It was cited (as precedent) in the 2015 decision that supported same-sex marriage. I wrote the script for this strip back in 2010; considering the current turmoil surrounding the court, I thought a bit more explanation might be in order.
